Judge Rules in Favor of Identity Theft Victim vs. Home Depot Gives Hope to Victims of Credit Damage21 May 2005
A 4th District Court of Appeals upheld the first $1 million judgment against Home Depot by a victim of identity theft. What makes this case very important is the courts recognition of a process for measuring credit damage to victims including identity fraud victims.
Georg Finder, the Credit Damage Expert Witness in this case states, “In the past it was thought impossible to measure credit damages to an individual, making it difficult to obtain a judgment. There is now a method of assessing credit damage that has proven successful numerous times in court. And, that is radically changing the outlook for victims of identity theft and helping to define how they can fight back.”
Victims of identity theft have been on the rise in the U.S. both online and offline. According to the Federal Trade Commission, right now, at least one in seven people is a victim of some kind of identity theft. Finder explains, “The recent problems at ChoicePoint, and the first lawsuit filed against them in February, is only the beginning. People need to start being aware of what they are doing to expose themselves to thieves and, of course, what precautions they can take. In addition, now they can get compensated for the credit damage that is inflicted upon them.”
Finder first testified on behalf of an identity theft victim in 2001. This victim suffered $40,000 in depleted accounts as well as new accounts opened using his stolen identity. Finder was able to measure the amount of the damages at $170,000 which turned into the amount of the bench ruling.”
